Terms of Use

These terms cover your use of Ember, the Android ↔ Mac sync app, including its optional cloud relay. Ember is made by CoolSolve LLP (“we”, “us”). By installing or using Ember, you agree to these terms. If you don't agree, please don't use it.
1. Using Ember
We give you a personal, non-exclusive, non-transferable, revocable license to install and use the Ember apps on devices you own or control, for your own use. You may not sell, rent, sublicense or redistribute the apps, or reverse engineer them except where the law allows it.
Ember includes third-party software components, which are licensed under their own terms.
To create a cloud sync account, you must be at least 13 years old (16 in the EEA).
2. Acceptable use
Don't use Ember, and especially the relay, to:
- break the law or infringe anyone else's rights;
- send malware or anything designed to harm devices or data;
- disrupt, overload or attack the relay or our sign-in service, or probe them for weaknesses without our permission;
- get around rate limits, sign-in checks or other access controls;
- use someone else's email address without permission, or create accounts by automated means;
- offer the relay to others as a service, or use it for anything other than syncing your own paired devices.
Because everything you sync is end-to-end encrypted, we can't see it. You're responsible for what you sync and for keeping your devices secure.
3. Your account
Cloud sync needs an account, which you sign in to with your email address and a one-time code. Use an email address you control, and don't share your codes. You can delete your account at any time, in either app under Settings → Account → Delete Account or at ember.balakumar.dev/delete-account.
4. The cloud relay
The relay is an optional extra that connects your devices over the internet when Bluetooth and Wi-Fi can't. It's provided “as is” and “as available”. We don't promise any level of uptime or speed, and we may change it, set reasonable usage limits, or pause or end it. If we plan to end it, we'll try to give you reasonable notice. Local sync over Bluetooth and Wi-Fi doesn't depend on the relay and keeps working either way.
5. Suspension and termination
We may suspend or close a cloud sync account, or block access to the relay, if it's used in breach of these terms, if it puts the service or other people at risk, or if the law requires it. Where it's reasonable and allowed, we'll tell you why. You can stop using Ember at any time. Uninstalling the apps and deleting your account ends this agreement.
6. Pricing and future paid plans
Ember is free, and cloud sync is free for now. We may introduce paid plans for cloud sync in the future. If we do:
- we'll show you the price and what's included before you pay, and we won't charge you unless you choose to buy;
- purchases will be billed through the App Store or Google Play, and their terms will govern payment, renewal, cancellation and refunds;
- local sync over Bluetooth and Wi-Fi will stay free.
7. App Store and Google Play
These terms are between you and CoolSolve LLP, not Apple or Google. We, not they, are responsible for Ember and its support. If you got Ember for Mac from the Mac App Store, Apple's standard Licensed Application End User License Agreement also applies to the Mac app. Apple has no obligation to provide maintenance or support for Ember. Apple and its subsidiaries are third-party beneficiaries of these terms as they relate to the Mac app, and may enforce them. You confirm that you're not located in a country subject to a U.S. Government embargo, and that you're not on any U.S. Government list of prohibited or restricted parties. Google Play's terms apply when you get Ember from Google Play.
8. Ownership and feedback
Ember, its apps, the relay, the Ember name and logo belong to CoolSolve LLP. Your content belongs to you. If you send us feedback or ideas, we may use them without any obligation to you.
9. Privacy
Our Privacy Policy explains what data Ember handles and how. In short, we can't read what you sync, and cloud sync stores only your email address and sign-in records.
10. Disclaimers
To the extent the law allows, Ember is provided “as is”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise that Ember will be error-free, that every clipboard item, file or notification will arrive, or that data won't be lost. Keep your own backups of anything important. Don't rely on mirrored notifications for emergency or safety-critical alerts.
11. Limitation of liability
To the extent the law allows, CoolSolve LLP won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, profits or revenue, arising from your use of Ember. Our total liability for any claim about Ember is limited to the greater of the amount you paid us for Ember in the 12 months before the claim and US$50.
Nothing in these terms limits liability that can't be limited by law, such as for fraud, or for death or personal injury caused by negligence. Nothing here affects rights you have as a consumer that can't be waived by contract.
12. Changes to these terms
We may update these terms from time to time. We'll post the new version here and update the date at the top. If a change is significant, we'll also tell you in the app or by email before it takes effect. If you keep using Ember after a change takes effect, you accept the updated terms.
13. Governing law and disputes
These terms, and any dispute arising out of or relating to them or to Ember, are governed by the laws of India. The courts at Bangalore, Karnataka have exclusive jurisdiction over any such dispute. If you're a consumer, this doesn't take away any protection you have under the mandatory laws of the country where you live.
If any part of these terms can't be enforced, the rest stays in effect. If we don't enforce a term right away, we haven't given up the right to enforce it later.
